MyBioKit Terms of Service

1. The Platform

MyBioKit ("the Platform") is a link-in-bio service operated by One Full Box LLC ("we," "us," "our"). The Platform provides creators with tools to build profile pages, share links, and offer products, services, tips, and bookings through customizable widgets.

2. Platform Role — Technology Provider

MyBioKit is a technology platform, not a seller, merchant, or payment processor. When you purchase a product, service, or booking through a creator's page:

The creator is the seller of record and is solely responsible for fulfillment, delivery, quality, and customer service.
MyBioKit provides the software tools that facilitate the transaction but does not manufacture, warehouse, ship, or guarantee any product or service.
Payments are processed through the creator's own connected payment account (e.g., Square). MyBioKit does not hold, escrow, or control buyer funds.
Any platform service fee is disclosed at checkout and is separate from the purchase price.

3. Creator Agreement

By selling through MyBioKit as a creator, you agree that you are an independent seller, not an employee, agent, or partner of MyBioKit. You agree to:

Provide accurate product descriptions, pricing, and delivery timelines.
Publish a clear refund and cancellation policy before accepting any payments. You cannot accept payments without a published policy.
Fulfill all orders promptly and as described. For physical goods, comply with the FTC Mail Order Rule (ship within the promised time or 30 days; offer cancellation and refund if delayed).
Honor your published refund and cancellation terms.
Attend all paid bookings or provide a full refund. If you cancel, the buyer may choose a full refund or rescheduling.
Respond to buyer inquiries and complaints in a timely manner.
Comply with all applicable laws, including consumer protection, tax, and product safety regulations.
Not sell prohibited items, including but not limited to: illegal goods or services, counterfeit products, weapons, drugs, adult services, or any item that violates applicable law.

4. Refunds, Returns, and Cancellations

4.1 General Policy

All sales are final, except where required by applicable law. This means:

Change of mind: Sellers are not required to offer refunds for buyer's remorse, subject to their individual policies and applicable law.
Defective, not as described, or not delivered: Buyers are entitled to a refund under applicable consumer protection laws. No "all sales final" policy overrides these rights.
Duplicate charges or processing errors: Buyers are entitled to a refund of the erroneous charge.

4.2 Digital Products

Digital products (downloads, templates, presets, courses) may be designated as non-refundable for change of mind after access or delivery, where permitted by law. This does not eliminate rights related to non-delivery, material misrepresentation, or unauthorized transactions.

4.3 Physical Products

Each physical product listing must display the applicable return and refund policy before purchase. Sellers must comply with the FTC Mail Order Rule and all applicable shipping, warranty, and consumer protection requirements.

4.4 Bookings and Services

Sellers must disclose cancellation, rescheduling, and no-show policies before payment. Default standards:

Buyer cancels 48+ hours before: Full refund or free rescheduling.
Seller cancels: Full refund or rescheduling at the buyer's choice.
Seller no-show: Full refund. Rescheduling only with the buyer's explicit agreement.
Buyer no-show: Subject to the seller's disclosed no-show policy.

4.5 Tips

Tips are voluntary payments made to support a creator. They are not payment for a specific product or service unless expressly stated otherwise. Tips are generally non-refundable, except where required by law, for duplicate payments, or for processing errors. Tips to individual creators are not tax-deductible charitable donations.

4.6 Donations

Donation goals set by individual creators are not charitable donations to a qualified nonprofit organization unless expressly stated. They are subject to the same terms as tips above.

5. Dispute Resolution

If you have an issue with a purchase:

Contact the seller first. Most issues are resolved directly.
If unresolved after 48 hours, contact us at support@mybiokit.com.
MyBioKit may, at its sole discretion, investigate complaints, facilitate refunds, suspend listings, or restrict accounts in cases of suspected fraud, non-delivery, material misrepresentation, or legal compliance requirements.
MyBioKit's intervention does not make MyBioKit a party to the transaction or liable for the seller's obligations.

6. Chargebacks and Payment Disputes

Buyers retain the right to dispute transactions through their payment provider. A published refund policy does not prevent a buyer from initiating a payment dispute. Creators are solely responsible for all chargebacks, reversals, and associated fees arising from their sales. Creators agree to reimburse MyBioKit for any chargeback costs, fees, or losses that MyBioKit incurs in connection with the creator's transactions.

7. Pro Subscriptions

7.1 Free Trial

New Pro subscribers may receive a free trial (trial length is set by the platform and shown at checkout; currently 14 days). To start your trial, you must provide a valid payment method (credit or debit card). Your card will not be charged during the trial period.

If you cancel before the trial ends, you will not be charged.
If you do not cancel before the trial ends, your card will automatically be charged the subscription price on day 15, and your Pro subscription will begin.
Each user is eligible for one free trial. Creating multiple accounts to obtain additional trials is prohibited and may result in account termination.

7.2 Automatic Renewal

By providing your payment method and starting a trial or subscription, you expressly authorize MyBioKit to automatically charge your card on file for the subscription price at each billing interval (monthly or yearly, as selected) until you cancel. You will be charged in advance for each billing period.

Monthly plan: Charged on the same calendar date each month.
Yearly plan: Charged once per year on the anniversary of your subscription start date.
We will notify you at least 30 days before any price increase. Continued use after the increase constitutes acceptance.
If your payment fails, we will attempt to retry. Your Pro access may be suspended if payment cannot be collected.

7.3 Managing Your Subscription

You can manage your subscription at any time from the Money tab in your account, including:

Viewing your current plan, billing date, and payment method.
Updating your card on file.
Switching between monthly and yearly billing.
Canceling your subscription.

7.4 Cancellation

You may cancel your subscription at any time. To cancel, go to the Money tab in your account and select "Cancel subscription," or contact support@mybiokit.com.

Access continues until expiry: When you cancel, your Pro features remain active until the end of your current paid billing period. You will not be charged again.
No partial refunds: We do not offer prorated refunds for unused days in a billing period. If you cancel mid-month, you keep Pro until the month ends, but the payment for that month is non-refundable.
Trial cancellation: If you cancel during the 14-day free trial, you will not be charged and Pro features end immediately.

7.5 No Refunds on Subscriptions

Subscription payments are non-refundable. Because you can cancel at any time and retain access until the end of your paid period, we do not issue refunds for subscription charges, including but not limited to: change of mind, unused features, or forgetting to cancel before renewal. The free trial exists so you can evaluate Pro before being charged.

If you believe you were charged in error (e.g., duplicate charge, charge after confirmed cancellation), contact support@mybiokit.com within 30 days and we will investigate.

7.6 Price Changes

We may change subscription prices. Existing subscribers will be notified at least 30 days before any increase takes effect. If you do not agree to the new price, you may cancel before the next billing date.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYBIOKIT AND ONE FULL BOX LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR ANY TRANSACTION WITH A CREATOR. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT OF PLATFORM FEES WE COLLECTED FROM THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

Nothing in these terms limits liability where such limitation is prohibited by applicable law.

9. Indemnification

Creators agree to indemnify, defend, and hold harmless MyBioKit and One Full Box LLC from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from: (a) the creator's products, services, or content; (b) the creator's breach of these terms; (c) the creator's violation of any law; or (d) any dispute between a creator and a buyer.

10. Account Termination

We may suspend or terminate any account that violates these terms, engages in fraud, fails to fulfill orders, accumulates excessive chargebacks (above 1%), or otherwise harms the Platform or its users. Creators with terminated accounts forfeit any unpaid platform balances to cover outstanding refunds and chargebacks.

11. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via email or prominent notice on the Platform at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.

12. Governing Law

These terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in New York County, New York.
